This will cover basic knowledge on the Uniform Code of Military Justice, as well as cover some of the random questions people have regarding UCMJ articles:



A: All members of the armed forces, active and reserve, are subject to the UCMJ. (Article 2)

Q: Can I really be NJP'd for getting a sunburn?

A:
Upon further reading, the answer appears to be NO. Article 108 does NOT refer to service members as property of the government. There are other articles which one can be punished under for intentionally hurting yourself, regardless of its affects on your performance of duty, but there are no provisions in the UCMJ for negligent harm done to oneself.



Q: What are the types of Discharge from the armed forces?
A: There are 5 types of discharge:

Honorable
General Under Honorable Conditions
General Under Other than Honorable Conditions
Bad Conduct (Special and General Court Martial)
Dishonorable (General Court Martial)



A: ANYONE may initially prepare a charge sheet. "When the offense has been identified, a Charge Sheet, DD Form 458, is prepared." This means that anyone can charge anyone else for anything, regardless of rank or billet. If a Pvt is hazed by a Lt., that Pvt can write up a charge sheet for Article 93 (Maltreatment), 124 (Maiming), 128 (Assault) and 92 (failure to obey MCO 1700.28 Hazing). Depending on the circumstances, Articles 80 and 81 might also be invoked.

The first two to remember are Articles 15 (NJP) and 31 (Rights of the Accused).

Punitive Articles:
80 - Attempts
81 - Conspiracy

85 - Desertion
86 - Absent Without Leave (UA - Unauthorized Absence)
87 - Missing Movement

89 - Disrespect toward a superior commissioned officer
90 - Assault or willfully disobeying a superior commissioned officer
91 - Insubordinate conduct toward a warrant officer, non-commissioned officer, or petty officer
92 - Failure to obey an order or regulation
93 - Cruelty and maltreatment

108 - Loss, damage, destruction, or wrongful disposition of military property
114 - Dueling (my personal favorite)

120 - Rape
121 - Larceny
122 - Robbery
124 - Maiming
126 - Arson
128 - Assault

133 - Conduct unbecoming of an officer and a gentleman
134 - General Article
